1. Acceptance of Terms

Welcome to PrimeLot Cards. By accessing or using our marketplace platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

PrimeLot Cards is an online marketplace that connects buyers and sellers of trading cards, including sports cards, Pokemon TCG, One Piece TCG, and other collectible card games. We provide the platform for transactions but do not own, sell, or control the cards listed by sellers.

3. User Accounts

3.1 Account Registration

To use certain features of our platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms of Service or for any other reason at our sole discretion.

4. Seller Obligations

4.1 Listing Accuracy

Sellers must provide accurate descriptions, images, and pricing for all listed cards. Misrepresentation of card condition, authenticity, or other material facts is strictly prohibited.

4.2 Shipping Requirements

Sellers must ship sold items within 3 business days of purchase. Sellers are responsible for providing tracking information and ensuring items are properly packaged to prevent damage during shipping.

4.3 Shipping Insurance and Liability

Optional Shipping Insurance: PrimeLot Cards offers optional shipping insurance powered by XCover at a cost of 1.25% of the item value for domestic shipments (Canada and USA). Insurance covers loss, damage, and theft during transit.

Insurance Requirements: Shipping insurance is REQUIRED and cannot be declined for items valued at $250 or more. For items valued between $100-$249, insurance defaults to enabled but may be declined at the seller's discretion. For items under $100, insurance is optional.

Seller Liability Without Insurance: If a seller chooses not to purchase insurance (where permitted), the seller assumes full responsibility and liability for any loss, damage, or theft of the shipment during transit. This means:

  • If the package is lost in transit, the seller may not receive their payout and may be required to refund the buyer
  • If the package arrives damaged due to transit or inadequate packaging, the seller may be liable for a full or partial refund
  • If the package is stolen during transit (before delivery), the seller may be held responsible
  • The seller bears all financial risk and liability for uninsured shipments

Claims Process: For insured shipments, sellers may file claims through the platform within the coverage period. PrimeLot Cards will review and submit qualifying claims to XCover on behalf of the seller. Claim approvals and payouts are at the sole discretion of XCover and subject to their terms and conditions. PrimeLot Cards makes no guarantees regarding claim outcomes.

Platform Liability: PrimeLot Cards is not responsible for lost, damaged, or stolen shipments, whether insured or uninsured. Our role is limited to facilitating the optional insurance service and claims submission process. Sellers are encouraged to purchase insurance to protect their financial interests.

4.4 Seller Fees

PrimeLot Cards charges 0% commission on sales - sellers keep 100% of their sale price. Sellers pay a flat monthly subscription fee of $5 CAD (currently free during beta) plus the standard 3.6% Stripe payment processing fee on each sale.

4.5 Payout Terms

Seller payouts are held until 2 days after delivery to provide buyer protection. After 2 days from delivery, funds are released to the seller's account. Chargebacks or disputes may extend this holding period.

5. Buyer Obligations

5.1 Payment

Buyers agree to pay the full purchase price for items at the time of checkout. All payments are processed securely through Stripe.

5.2 Buyer Protection Period

Buyers have 2 days after delivery to report issues with their order, including items not received, items not as described, or damaged items. Claims submitted after 2 days from delivery may not be eligible for resolution.

6. Payment Processing

All payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service. We do not store credit card information on our servers.

Prices are displayed in your local currency based on your location. Currency conversion is handled automatically at checkout.

7. Disputes and Refunds

7.1 Dispute Resolution

If a buyer reports an issue during the 2-day protection period after delivery, we will investigate the claim and may request evidence from both parties. We reserve the right to issue full or partial refunds based on our investigation.

7.2 Refund Policy

Refunds may be issued for items that are not as described, not received, or significantly damaged. Return shipping costs are typically the responsibility of the seller in cases where the seller is at fault.

7.3 Chargebacks

Buyers who initiate chargebacks through their credit card company without first attempting to resolve the issue through our platform may have their accounts suspended. Sellers who receive excessive chargebacks may face account restrictions.

8. Prohibited Activities

You agree NOT to:

  • List counterfeit, fake, or unauthorized reproduction cards
  • Engage in fraudulent activities or misrepresent items
  • Manipulate prices or engage in shill bidding on offers
  • Harass, threaten, or abuse other users
  • Use automated systems (bots) to access the platform
  • Violate any applicable laws or regulations
  • Circumvent our fee structure or payment processing
  • Create multiple accounts to evade restrictions
  • Share or sell your account credentials

9. Intellectual Property

The PrimeLot Cards platform, including its design, logos, text, graphics, and software, is owned by PrimeLot Cards and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Card images and descriptions uploaded by sellers remain the property of the respective sellers, but sellers grant PrimeLot Cards a non-exclusive license to display and promote their listings.

10. Limitation of Liability

PrimeLot Cards acts as an intermediary marketplace platform. We are not responsible for the accuracy of listings, the quality of items, shipping delays, or disputes between buyers and sellers. While we provide buyer protection and dispute resolution services, we make no guarantees about transaction outcomes.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIMELOT CARDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

11. Privacy and Data Protection

Your use of PrimeLot Cards is also governed by our Privacy Policy. By using our platform, you consent to our collection and use of personal data as outlined in our Privacy Policy.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes via email or platform notification. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. PrimeLot Cards is based in Brantford, Ontario, Canada. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

14. International Users

PrimeLot Cards operates from Canada and provides services to users in Canada and the United States. By using our platform from outside these regions, you acknowledge that your information may be transferred to, stored, and processed in Canada and you consent to such transfer and processing.

16. Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

17. Entire Agreement

These Terms of Service, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PrimeLot Cards regarding your use of the platform.

By using PrimeLot Cards, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
